Manos Home Care, Inc. (“Company,” “we,” “us,” or “our”) is committed to protecting your privacy. This Privacy Policy describes how we collect, use, disclose, and protect your personal information when you interact with our websites, online platforms, and related digital tools (including automated features such as chatbots, collectively, the “Services”).

This Policy complies with the California Consumer Privacy Act of 2018, as amended by the California Privacy Rights Act (collectively, the “California Privacy Laws”).

1.    Scope
This Privacy Policy applies to individuals residing in the State of California and to others whose personal information is processed in connection with our Services. By accessing or using the Services, you agree to the terms of this Policy.

2.    Categories of Information We Collect
We may collect personal information including identifiers such as your name, email address, telephone number, and IP address. We also collect commercial information such as records of services considered or purchased, and internet or other electronic network activity, including your interactions with our websites or chat interfaces. If you enable location services, we may collect geolocation data. If you engage in video or phone calls with us, we may collect audio and visual information. For employment applicants, we may collect professional or employment-related information.

Because we provide services to children and adults with developmental disabilities, we may also collect health-related information, including diagnoses, care plans, and treatment history. This data is treated as sensitive personal information. Additionally, we may generate inferences from your usage patterns or chatbot interactions to improve service delivery. We only collect sensitive personal data that is relevant to our operations and necessary to provide the Services.

If services are funded through a government-sponsored program, such as Medicaid, a regional center, or a state health department, we may also be required to collect, use, and share information in accordance with that program’s applicable regulations and agreements. This may include submitting data for reimbursement, monitoring outcomes, supporting audits or investigations, and complying with federal or state program requirements.

3.    Sources of Personal Information
We collect personal information directly from individuals, including through online forms, account registration, chatbot interactions, or direct communication. For services involving children, we collect information from parents or legal guardians who are authorized to provide such data. We also collect certain data automatically through cookies and similar technologies. In some cases, we may receive personal information from third parties, including analytics providers, referral platforms, or background check services.

4.    Use of Personal Information
We use personal information to provide and improve our Services. This includes delivering in-home developmental disability support services, managing care coordination and treatment documentation, and responding to inquiries or requests, including those submitted through chatbots. We also use personal data to analyze usage trends, improve the quality of our offerings, and fulfill legal and contractual obligations. Where applicable, we process employment-related data to evaluate job applications and support internal workforce operations.

We do not use health-related or child-related information for advertising or any commercial marketing purposes. We may use de-identified or anonymized information to support internal research or improve operational effectiveness.

5.    Sensitive Information and Children’s Data
Our Services include in-home support for children with developmental disabilities. As part of this work, we collect sensitive personal information such as medical diagnoses, treatment plans, behavioral assessments, and developmental goals. This information is obtained from and with the consent of a parent or legal guardian and is used solely to deliver and manage care, comply with applicable legal requirements, and improve the quality of our Services.

We do not knowingly collect data directly from individuals under the age of 18. Our Services are not designed for use by children independently. Any child-related information collected is provided by a responsible adult with appropriate authority.

6.    Chatbot Use and Data Collection
We may offer chatbots and other automated tools as part of our Services to enhance communication, support navigation, and improve accessibility. When you engage with a chatbot, we may collect the content of the conversation, as well as metadata such as timestamps, device information, and browser settings. If you choose to provide your name, contact information, or service-related questions during the chatbot interaction, that information will be used to assist you and may be logged to support service improvement.

Chatbot data may be monitored for quality control, troubleshooting, or technical optimization. In some cases, de-identified data may be used to improve the performance of these tools. We do not use chatbots for automated decision-making that has legal or similarly significant effects without human review.

7.    Sharing of Personal Information
We may share personal information with third-party service providers who assist us with technical infrastructure, communications, care management, or chatbot functionality. We may also share information with affiliates for internal operational purposes. If our business is involved in a merger, acquisition, or asset transfer, personal data may be included in the scope of such transaction.
We may disclose information when required to comply with laws, regulations, legal processes, or governmental requests. Where services are funded through a public agency or government program, we may be required to share certain personal information, including health or demographic data, with those agencies for billing, oversight, or compliance purposes. We do not sell or share health-related or child-related personal information for advertising or marketing purposes. We will only disclose such information with your consent, at your direction, when legally required, or when required by the terms of a funding program in which you or your child are enrolled.

8.    Your Rights Under California Privacy Law
California residents have the right to request information about the personal data we collect, use, and share. You also have the right to request the correction or deletion of your personal data. This includes what is sometimes referred to as the “right to be forgotten,” meaning you may ask us to remove information we have collected about you, subject to applicable exceptions under the law. You also have the right to limit our use of sensitive personal information and to opt out of the sharing of data for cross-context behavioral advertising. We will not discriminate against you for exercising your privacy rights. To exercise these rights, you may contact us using the contact details at the end of this Policy. We may request verification of your identity before processing certain requests. If you are using an authorized agent, we may require confirmation of your authorization.

9.    Cookies and Tracking Technologies
We use cookies and similar technologies to enhance the functionality and security of our websites. These tools allow us to remember preferences, understand site usage, and improve performance. You can configure your browser settings to block cookies, although some features of our Services may not function properly without them.
We honor Global Privacy Control (GPC) signals where supported by browsers, and treat such signals as a valid request to opt out of the sale or sharing of personal information.

10.    Data Retention
We retain personal information only for as long as necessary to provide our Services and fulfill the purposes described in this Policy. This includes meeting legal, regulatory, and contractual obligations, as well as record retention requirements related to child services. Once retention is no longer necessary, we securely delete or anonymize the information.

11.    Security
We implement administrative, technical, and physical safeguards to protect your personal information from unauthorized access, disclosure, or misuse. This includes encryption, access controls, secure storage systems, and employee training. While we strive to maintain the security of our systems, no method of transmission or storage is entirely secure. You are responsible for protecting any account credentials used to access our Services.

12.    Children’s Privacy
We do not knowingly collect personal information directly from children under the age of 18. All data related to children is collected from parents or legal guardians. If we learn that we have inadvertently collected data from a child without proper authorization, we will take immediate steps to delete it.

13.    HIPAA and Health Information
Manos Home Care, Inc. isa Covered Entity under the Health Insurance Portability and Accountability Act (HIPAA). Regardless of our status under HIPAA, we treat all medical and disability-related data with high levels of confidentiality and implement security practices that align with industry standards.

14.    Changes to This Policy
We may revise this Privacy Policy from time to time to reflect changes in our practices or applicable laws. The effective date at the top of the Policy indicates when it was last updated. We encourage you to review this Policy periodically to stay informed about how we handle your information.
